Doctor Malpractice


Doctor malpractice occurs when a doctor intentionally does something wrong, negligently does something wrong, or doesn’t do something that he/she should have done and the patient is injured.

While doctor malpractice may be based on the intentional act of a doctor, it does not happen often. Seldom does a doctor intentionally and deliberately injure a patient.

Most doctor malpractice occurs from negligence – when a doctor does not do what a reasonably prudent doctor would do in the same circumstance and the patient is injured. A doctor may perform a medical procedure on a patient, but perform the procedure incorrectly and injure the patient. A doctor may not perform a certain medical procedure or not require certain test when a reasonably prudent doctor faced with the same circumstance would perform the procedure or require the test, and the patient is injured because the procedure was not done or the test taken.
